This Revision Petition is directed against the orders dated 6.10.2003 and 17.12.2004 passed by the learned Additional Civil Judge [Senior Division] and the learned Additional District Judge at Rewari respectively, whereby an application under Order 39 Rules 1 and 2 read with Section 151 CPC filed by the petitioners has been dismissed and affirmed in appeal.

While issuing notice of motion on 17.03.2005, the parties were directed to maintain status quo regarding construction.

The interim order dated 17.03.2005 is operating from last more than four years and the parties have apparently reconciled with the same. It is stated by learned counsel for the parties that though the suit has not been decided so far, but the same is near to conclusion.

Since the interim order is operating from last more than

four years, in my considered view, there is no need to go into the rival contentions of the parties. Rather, I deem it appropriate to dispose of the revision petition with a direction that the interim order as granted by this Court shall continue to operate till the civil suit is decided.

Nothing said in the impugned order as also this order shall be construed as an expression of opinion on the merits of the case.
