Learned counsel for the petitioner contends that in regard to the incident mentioned in the FIR, the petitioner has not been ascribed any role. The petitioner, rather, has been implicated on the basis of disclosure statement of an accused, which relates to some other alleged incident. In these circumstances, the petitioner cannot be asked to stand trial in the present FIR.
Learned counsel for the petitioner wants to withdraw the petition so as to raise the argument noticed above before the trial Court, as the entire material would be before the trial Court.
Dismissed as withdrawn with liberty as prayed for.
