On the asking of Court, Shri Rajeev Sharma, Central Government Standing Counsel, who is present in Court, accepts notice on behalf of the respondents.
Copies of the writ petition have been supplied to the learned counsel for the respondents.
The petitioner has approached this Court for issuance of directions to the respondents for correction of the date of birth of the petitioner in the passport. According to the petitioner, the date of birth of the petitioner has been wrongly entered as October 20,1973 instead of October 28, 1973. It has also been pleaded by the petitioner that a passport was issued in favour of the petitioner on July 4, 2006 and on receipt of the aforesaid passport, the petitioner
found that his date of birth has been wrongly mentioned. Consequently, the
petitioner approached the authorities for correction of the date of birth and submitted his passport for the aforesaid correction. No action whatsoever has been taken in this regard so far.
The petitioner also appears to have issued a legal notice dated October 30,2006 (Annexure P.4). The aforesaid legal notice has remained unresponded.
In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to the Regional Passport Officer, Jalandhar, respondent No.2 to take a final decision on the aforesaid legal notice (Annexure P.4) within a period of two months from the date a certified copy of this order is received and take such further appropriate action, as may be required, in accordance with law.
A copy of the order be given dasti on payment of usual
charges.
