With the consent of both the parties, this writ

application is being disposed of at this stage itself.

In the present writ application, the petitioners have prayed for the grant of following reliefs:

“(i) For direction to respondent to consider the representations filed by the petitioners and on such due consideration, to extend and grant the same benefit such as seniority, pay scale, salary, annual increments, ACPs to the petitioners as has been extended to the similarly situated employees, who were appointed earlier pursuant to the same advertisement no.210/2010 and panel, as the denial of same service benefits would amount to denial of right to equality guaranteed under Article 14 and 16 of the Constitution of India.

(ii) For commanding the respondents to extend all service benefits to

the petitioners as aforesaid by notionally before joining and actually after joining with effect from the date as received by the employees, who were admittedly junior to the petitioners on account of acquiring requisite qualification much later and placed much below in the panel approved by Hon'ble Supreme Court, as adjudicated and covered vide order dated 08.12.2025 passed by this Hon'ble Court in CWJC 15663/2022 (Santosh Kumar & Ors Vs The State of Bihar & Ors).

(iii) For any other order/orders or relief/reliefs which the petitioner may found to be entitled in the facts and circumstances of the case.”

At the outset, learned counsel appearing for respondent-State submits that he has filed a counter affidavit through online mode and a physical copy of the same is being produced in the Court today, the same is taken on record.

After advancing some argument, learned counsel appearing for the petitioners submits that all the petitioners are prepared to file fresh individual representations before their respective District Education Officer. He further prays that if such representations are filed, they may be directed to be disposed of by the District Education Officer of the concerned

district before whom the representations would be filed, within a fixed time frame, after giving opportunity of hearing to the concerned petitioners.

To the aforesaid submission made by learned counsel for the petitioners, learned counsel appearing for respondent-State does not have any objection.

Considering the limited nature of prayer being made by learned counsel appearing for the petitioners, this writ application is disposed of granting liberty to all the petitioners to file their individual representation before the District Education Officer of their respective area within one month from today. If such representations are filed by the petitioners, the District Education Officers of the respective area are directed to dispose of the same within six months from the date of receipt of the representations, after giving an opportunity of hearing to the concerned petitioners. Needless to emphasize that the final order which shall be passed by the District Education Officer of the respective districts should be a reasoned and speaking order and in accordance with law. It is also made clear that in case, the petitioners are found to be entitled to the relief, which they would be claiming through the representations then the same should be extended to the petitioners by the respective District

Education Officers within a further period of three months from the date of passing of the final order.

With the aforesaid observation/direction and liberty granted, the writ petition stands disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
