The instant writ application has been filed for the following relief(s):-

appropriate writ and /or order and / or direction commanding the respondents to remove the encroachment from the Government land in the nature of Gair Majarua Malik Land (Phulwari) under the district of Munger in Mauza-Ktariya, Thana No. 134, Khata No. 53, Khesra No. 125, Area 19.60 Acre by initiating a proceeding under the Bihar Public Land Encroachment Act. The abovesaid land is under encroachment of the private respondent nos. 7 to 15 without any valid title and interest in the property.”

The petitioner is directed to file a fresh

representation along with the earlier representation dated 28.03.2024 with regard to the encroachment, in question, giving full details of the persons who have made construction over the land and creating obstruction over the public road/land by blocking the same.

It is expected that once such an application for removal of the encroachment is filed by the petitioner, then the Circle Officer, Sadar Munger will initiate the appropriate proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956 and, after giving notice to all concerned, necessary orders shall be passed, adjudicating the issues, in question, and once it is found that the land, in question, is a public land and the same has been encroached by the private persons, which shall be made encroachment free within the statutory period as per law.

It is expected that the entire exercise shall be carried out and concluded expeditiously within the time so specified under the statute from the date of initiation of proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956.

With the aforesaid observation and direction, the writ petition stands disposed of.
