The petitioners have filed the instant application for

the following relief(s):

“(i) Issuance of a direction, order or writ, including writ in the nature of Mandamus directing the Respondent Number 2 to issue directions with regard to regularization of the services of the petitioners who have been working in Patna Municipal Corporation on contractual basis against sanctioned posts.

(ii) Issuance of a direction, order or writ, including writ in the nature of mandamus directing the Respondent Authorities to consider the case of the petitioners for regularization from the date when the resolution was first passed i.e. in the year 2018 as it is only due to the delay by Respondent Number 2 that the petitioners have not been regularized till date.

(iii) Issuance of a direction, order or writ, including writ in the nature of mandamus directing the Respondent Authorities to make payment of all the

arrears and benefits to the petitioners on account of regularization and to consider the length of service while grant of retirement benefits.

(iv) Issuance of a direction, order or writ, including a writ in the nature of mandamus directing the Respondent Authorities for grant of all consequential benefits in nature of arrears of pay or any other benefit which the petitioners entitled to.

(v) Any other relief/reliefs that the petitioner may be found to be entitled to in the facts and circumstances of the present case.”

Having heard learned counsel for the parties and

having perused the contents of the petition, the writ application is disposed of directing the petitioners to file their individual/separate representations before the Principal Secretary, Urban Development and Housing Department, Government of Bihar, Patna (respondent no.2) within a period of four weeks.

In case the representation is filed, the same shall be decided by the respondent no.2 by separate orders within a period of three months from the date of its filing and the orders shall be communicated to the petitioners separately/individually forthwith.

It is made clear that the Court has not entered into the merits of the case of the petitioners which is to be decided by the respondent concerned.
