The petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 10 of 2025, instituted for the offences punishable under Sections 126(2), 115(2), 118(2), 308(2), 109(1), 303(2) an 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that the petitioner and other co-accused persons stopped the vehicle of the informant and demanded Rs. 50,000/- in extortion. On saying of co-accused Chandni Yadav, other co-accused persons pulled the informant out from his vehicle and snatched his gold chain and also assaulted the informant by means of butt of gun.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submitted that the petitioner has been arrested only on the basis of suspicion. No specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. Specific allegation of assault is attributed against co-accused, namely, Raj Babbar Yadav. It is next submitted that the petitioner was out of station on the alleged date of occurrence but his name has been arrayed as member of mob. The petitioner is in custody since 18.10.2025 and has got six criminal antecedents. Learned counsel for the petitioner further submitted that other co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 04.02.2026 passed in Cr. Misc. No. 5855 of 2026.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sahebpur Kamal P.S. Case No. 10 of 2025, subject to the following conditions:

(I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial and shall not remain absent on two consecutive dates without sufficient cause.

(III) The petitioner will not tamper with the evidence or the witnesses during the trial.

¶27

(IV) Petitioner shall not commit offence of similar nature in future.

¶28

If any of the above conditions are violated, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
