Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing

on behalf of the State.

The accused/petitioner apprehending his arrest

in connection with Sangrampur P.S. Case No. 444 of 2025 registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 117(2), 74, 75, 303(2), 329(4), 324(4) of the BNS.

The allegation against the petitioner is that on

18.11.2025, the petitioner forcibly entered the informant's

¶20

house and started molesting her. It is alleged that when the informant called her husband, the petitioner assaulted him,

and upon a hue and cry, other co-accused persons arrived, assaulted the informant’s family, damaged household property, and fled. It is further alleged that the petitioner had been blackmailing and sexually harassing the informant through an objectionable video for the past ten years and had fraudulently withdrawn Rs. 5 lakhs from her bank account.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner and the informant are agnates and there is property dispute between them. It is further submitted that on the date of occurrence, a minor scuffle took place and the present FIR is an exaggerated version of the incident. It is also submitted that there is a case and counter case between the parties and petitioner is a man of clean antecedent. It is further submitted that both sides sustained injuries.

Learned APP for the State has opposed the prayer of anticipatory bail.

Having considered the rival submissions and keeping in view the old land dispute between the parties, there is case and counter case and clean antecedent of the petitioner, this

Court is inclined to grant the privilege of anticipatory bail. Accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, East Champaran at

Motihari/concerned court, in connection with Sangrampur P.S. Case No. 444 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS.
