The petitioners seek anticipatory bail in connection with Ekangarsarai, P.S. Case No. 48 of 2026, registered for the offence punishable under Section 126(2), 115(2), 109(1) and 3(5) of B.N.S.

The case of the prosecution, in short, is that there was minor scuffle between both the parties on the eventful day on account of a long-standing dispute, in which petitioner no. 1 allegedly assaulted on the head of the informant's son, and petitioner no. 2 assaulted the brother-in-law of the informant while he was attempting to intervene.

Learned counsel for the petitioners submits that both the parties are neighbors and have sustained injuries in the incident. It is further submitted that there is a case and countercase between the parties. Lastly, he submits that the nature of the injuries has been opined by the doctor to be simple in nature and the petitioners bear a clean antecedent.
