Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

The accused/petitioner apprehending his arrest in connection with Parihar P.S. Case No. 284 of 2023 registered for the offences punishable under Sections 406, 409, 420, 34 of the Indian Penal Code.

The allegation against the petitioner is that he is the Chairman and non submission of 2257.53 quintal of paddy is against him. Consequently, a loss of Rs. 46,61,799.45/- to government exchequer has been calculated.

At the outset, learned counsel for the petitioner submitted that non submission of the paddy was due to its having been spoiled during the rainy season. However, the

petitioner is ready and willing to deposit the loss amount. It is further submitted that the petitioner has already deposited a sum of Rs. 14 lakhs. He is ready to deposit the remaining amount and prays for some time for the same.

Learned counsel for the State has no objection, if the petitioner abides by the commitment/undertaking made before this Court.

Having considered the submissions of both the parties, let the petitioner named above, in the event of his arrest or surrender before the learned trial Court, within a period of six weeks of the order, is directed to be released on provisional bail , furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned I/c J.M. 1^st Class, Sitamarhi/concerned Court, in connection with Parihar P.S. Case No. 284 of 2023, subject to the conditions as laid down under Section 482(2) of the BNSS, subject to condition that he shall deposit 25% of Rs. 32 lakhs (Rupees Thirty Two Lakhs) at the time of furnishing bail bond.
