Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The Petitioner is apprehending his arrest in connection with Barh P.S. Case No. 489 of 2025 registered for the offences punishable under Sections 61(2), 103 and 3(5) of the BNS and Section 27 of the Arms Act.

3. As per the prosecution case, on 17.08.2025 at about 09:00 P.M., the informant's son, namely Raj Kumar, aged about 17 years, went to sleep in his newly built house. The informant also went to sleep in a hut adjacent to the said house after closing its door. It is further alleged that on 18.08.2025 at about 04:00 A.M., the informant found the door to be open of the said house, where her son had been sleeping and she saw his dead body with a gunshot injury. petitioner, who is one of the brothers of one Bhuli Kumari, with whom the deceased allegedly had a love affair, had murdered her son in conspiracy with the other suspected co-accused persons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. It has been submitted that except suspicion, there is no material against the petitioner in the present case. It has further been submitted that there is no eye-witness to the alleged occurrence of the murder and the witnesses examined during the course of the investigation have also expressed suspicion only against the petitioner. Lastly, it has been submitted that the petitioner has clean criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner is suspected of having committed the murder of the informant's son. It has further been submitted that there is also a motive attributed to the petitioner.

7. Considering the aforesaid facts and circumstances

course of investigation, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Patna in connection with Barh P.S. Case No. 489 of 2025, subject to the conditions as laid down under Section 482(2) of the (B.N.S.S.)
