2 . The petitioners are apprehending their arrest in connection with Nardiganj P.S. Case No. 450 of 2024 dated 23.12.2024 registered for the offences punishable under Sections 126(2), 115(2), 303(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita.

3 . As per the allegation, the petitioners along with 4-5 unknown persons waylaid the informant, who was driving an auto-rickshaw and started assaulting the informant, in course of which petitioner no.2 (Rajan Yadav @ Ranjan Kumar) snatched

his two mobile phones, while all the accused persons named and unnamed, including these petitioners, started assaulting the informant by means of lathi and danda – assault continued till he became unconscious, believing the informant to be dead, thereafter, all the accused persons fled away. It has further been alleged that anyhow the informant reached his house when his son Piyush Kumar called the police by dialing 112, whereafter constable took the informant to Nardiganj Government Hospital and thereafter he was referred to Sadar Hospital, Nawada for better treatment.

Learned counsel for the petitioners has submitted that from the FIR itself, it is clear that there is general and omnibus allegation against the petitioners and others, including four to five unknown persons, to have assaulted the informant. Learned counsel for the petitioners has submitted, referring to the injury report, which was called for by order dated 21.05.2026, that the injured informant received altogether three injuries, the first one being a lacerated bleeding wound on occipital region of head, the second one which was a wound on the left eye and the third one being swelling of right foot. The supplementary injury report goes to show that injury on head and on foot were found to be grievous in nature and the same is

not specifically attributed to these petitioners. Moreover, the injuries on foot is on non-vital part of the body, whereas the injury on head which is solitary one, there having been general and omnibus against the petitioner no.1 (Ramesh Yadav @ Balveer Yadav), the same cannot be specifically attributed to him. It has further been submitted that no blood was found at the place of occurrence. It has lastly been submitted that petitioners have got no criminal antecedents.

5 . Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

6. Heard the learned counsel for the parties and perused the record.

Considering the aforesaid facts and circumstances of the case as well as the general and omnibus allegation against the petitioners, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned court of Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 450 of 2024, subject to conditions as laid down under section 482(2) of the B.N.S.S.
