The petitioner seeks regular bail in connection with Ghogha P.S. Case No. 20 of 2026 lodged on 31.01.2026, for the offence punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act and Section 8(c) & 21(a) of the N.D.P.S Act, 1985 and Section 317(2) & 111(2)(B) of B.N.S, 2023, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur.

Prosecution case, in brief, is that on 31.01.2026 at about 3:00 hours, Sub-Inspector, recorded his self-statement regarding a mobile phone snatching. During investigation, accused Ravi Kumar disclosed that Abhishek Kumar and Bhado

@ Bhadwa committed the snatching at gunpoint and revealed details about the weapon and stolen articles. Acting on this information, police raided the house of Chandan Kumar and apprehended several persons including petitioner Devendra Kumar. The search allegedly led to recovery of country-made firearms, live cartridges, ten packets of smack wrapped in silver foil, three grams of smack in polythene, silver foil roll, four mobile phones, one steel knife and three motorcycles, including one stolen. The accused allegedly confessed to involvement in theft, snatching, stolen motorcycle sale and smack trafficking.

Learned counsel for the petitioner submits that the petitioner is innocent and it is mere co-incidence that he was at the sight where search was made and nothing incriminating has been recovered from his conscious possession. He further submits that the petitioner has clean antecedent. He also submits that the petitioner has been falsely been implicated in this case. He lastly submits that the petitioner is in judicial custody since 01.02.2026.
