The petitioner seeks bail in connection with Pauthu P.S. Case No. 109 of 2024 registered for the offences punishable under Sections 103 (1), 238, 61 (2), 123 of BNS which is pending before learned C.J.M., Aurangabad.

Prosecution case, in short is that, on 22.10.2024 at 4 a.m., the informant received a call and got information that his daughter was sick who is married to the petitioner in 2013. Since her marriage, the informant’s daughter was subjected to cruelty and torture. On hearing news of her daughter sickness, informant reached her matrimonial house and informed by the villagers that informant’s daughter and her two children were killed and dead bodies were concealed with the help of Scorpio

vehicle bearing registration No. BR05P7185. It is further stated that 10 accused persons including the petitioner and 3-4 unknown persons have killed the deceased and her two children by poisoning and pressing their neck.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and has falsely been implicated in the present case. The counsel further submits that the petitioner was working in a private company at Jaipur (Rajasthan) and he was not present at his village on the alleged day of occurrence. The counsel also submits that the deceased consumed poison and further poisoned her two sons and one daughter. Learned counsel for the petitioner further submits that mother and father of the petitioner took the deceased and her two children to the hospital.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Having heard the contention of the learned counsel for the parties and considering the nature and gravity of the offence, this court is not inclined to grant of bail to the petitioner at this stage.

Accordingly, the prayer for grant of bail to the petitioner is, hereby rejected.
