Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners seek regular bail in connection with Korha P.S. Case No. 132 of 2025, registered under Sections 103(1), 3(5) of the B.N.S., 2023.

As per prosecution case, the informant stated that his sister was married to one Sandeep Rishi. On 18.05.2025 at 9:30 P.M. he received information that she had died. On information, it transpired that Sandeep Rishi has strangulated his sister. The postmortem report as per the impugned order shows no external injury and even viscera was preserved but no poison was detected. The opinion of the doctor on reason of death was awaited.

Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that the petitioners are 24 and 22 years of age respectively and they are brother-in-law of the deceased. They are mere members of the family and have no role in the decision making or happening of the family. Moreover, the FIR has been lodged after delay of six days. Moreover, husband is already in custody since 04.06.2025. The petitioners have clean antecedent and they are in custody since 16.01.2026.

Learned APP for the State has vehemently opposes the prayer for bail of the petitioners.

That the petitioners are junior members of the household being brother-in-law of deceased and there is no specific allegation against them in the FIR. The cause of death even after viscera could not be ascertained. Similarly situated co-accused person, namely, Raj Kumari Devi has been granted anticipatory bail by a coordinate Bench of this Hon’ble Court vide dated 25.02.2026 passed in Cr. Misc. No. 10321 of 2026.

Accordingly, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/(Rupees Ten Thousand Only) each with two sureties of the like

amount each to the satisfaction of learned C.J.M. Katihar /concerned court below in connection with Korha P.S. Case No. 132 of 2025.

It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
