The petitioner seeks bail in a case registered for the

offence punishable under Sections 126(2), 115(2), 109(1), 352, 351(3) and 3(5) of B.N.S..

As per prosecution case, it is alleged that this petitioner assaulted informant and his nephew by means of lathi and iron rod.

Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. On account of petty dispute, maar-peet took place between the parties in which both sides sustained injuries. There is case and counter-case. Doctor has found the injuries,

allegedly caused by this petitioner, simple in nature. Moreover, charge-sheet has already been submitted and petitioner is in custody since 13.02.2026.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the facts and circumstance of the case, general and omnibus nature of accusation, case and counter-case between the parties, nature of injuries allegedly caused by this petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.

Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhauliya (Majhaulia) P.S. Case No. 413 of 2025.
