The petitioner seeks bail in a case registered for the offence punishable under Sections 87 and 3(5) of B.N.S. and Sections 4 and 6 of the POCSO Act.

As per prosecution case, it is alleged that this

petitioner, along with other F.I.R. named accused persons, kidnapped minor daughter of informant.

Learned counsel for the petitioner submits that

petitioner is quite innocent and has falsely been implicated in this case. During investigation, the victim was recovered and her statement was recorded under Section 183 of the B.N.S.S. wherein she denied the factum of kidnapping and categorically stated that she was in love with this petitioner and out of her own volition, she left her house and solemnized marriage with this petitioner. Moreover, charge-sheet has already been submitted and petitioner, having no criminal antecedents, is in custody since 13.01.2026.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the facts and circumstance of the case, statement of the victim recorded under Section 183 of the B.N.S.S., period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.

Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6^th District and Additional Sessions Judge-cum-Exclusive Special Judge, POCSO Act, East Champaran, Motihari in connection with Harsidhi P.S. Case No.
