Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the opposite party no. 2.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 406, 467, 468, 471, 504, 34 of the Indian Penal Code.

The petitioner is said to have prepared a forged document on stamp paper stating that he has given Rs. 25,000/as advance money to the informant in respect of two pieces of land.

Learned counsel for the petitioner submits that the present case essentially involves a civil dispute between the parties and after investigation, the police even submitted final

form stating the occurrence to be arising out of a land dispute between the parties (Annexure-P/2). However, differing with the final form, cognizance was taken as against the petitioner. It is further submitted that there is case and counter case and in the cross case also the police has also submitted the final form.

Learned APP for the State and learned counsel for the opposite party no. 2 have opposed the application for anticipatory bail on the basis of the allegations and also that there are criminal antecedents. However, in response to which, it has been submitted that the petitioner is on bail in all the cases.

Taking into consideration the facts and circumstances and also considering the facts that there is case and counter case and cognizance has been taken differing with the final form, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Nautan P.S. Case No. 413 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S. subject to the further conditions:
