Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 80, 85 and 3(5) of the B.N.S.

Petitioners along with other accused persons are said to have committed murder of the daughter of the informant.

Learned counsel for the petitioners submits that the present petitioners are the father-in-law, mother-in-law, brother-in-law, sister-in-law and a co-villager. Allegation has

been made on these petitioners in general and omnibus manner of having caused the death of the deceased on account of nonfulfillment of dowry demand. It is further submitted that the FIR itself has been lodged after a delay of more than one month and the petitioners who are the in-laws had no concern with day to day life and affairs of the deceased and her husband. Further, the petitioners are living separately from the deceased and her husband. It has next been pointed out that the deceased had actually consumed poison and the FSL report also during course of investigation demonstrates that aluminum phosphate was detected. Considering all the grounds, a coordinate Bench of this Court has granted the privilege of anticipatory bail to the husband of the deceased, who is primarily responsible for the welfare of the wife, vide order dated 09.07.2026 passed in Cr. Misc. No. 40680 of 2026.

Learned counsel for the State opposes the granted of anticipatory bail.

Taking into consideration the facts and circumstances and also considering the fact that the petitioners are all in-laws of the deceased and the husband has already been granted anticipatory bail by a coordinate Bench of this Court, let the above named petitioner be released on bail, in the event of his

arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Minapur P.S. Case No. 298 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
