The petitioner seeks regular bail in connection with S. Tr. No. 1246/2025, arising out of Janta Bazar P.S. Case No. 186 of 2025, registered under Section 103(1) of the B.N.S. and the charge sheet has been submitted under Sections 103(1), 118(1), 238, 61(2) and 3(5) of the B.N.S.

As per prosecution case, the allegation is that deceased left his house after receiving a call from one Sameer Kumar and thereafter his dead body was recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the FIR rather his

name has transpired in the confessional statement of the coaccused Sameer Kumar. There is no seizure from the petitioner to connect him with the alleged crime and the charge has been framed. Learned counsel further submits that the cause of death as per postmortem report is hemorrhage and shock caused by sharp object. The petitioner bears one antecedent and he is in custody since 08.08.2025.

Learned APP for the State has vehemently opposes the prayer for bail of the petitioner.

Considering that the case is based on circumstantial evidence and such claim can be tested only at the time of trial and not at bail stage and period of custody, this application is allowed.

Accordingly, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned 3^rd Additional Sessions Judge, Saran at Chapra/concerned court below, in connection with S.
