The petitioners seek anticipatory bail in connection with Kesariya P.S. Case No. 452 of 2025, registered for offences punishable under Sections 126(2), 115(2), 329(4), 118(1), 109, 305, 352, 351(2), and 3(5) of the B.N.S.

The prosecution case, in short, is that owing to a land and crop-grazing dispute, the accused persons allegedly assaulted the informant's husband, Md. Taiyab Ansari, and her

son with sharp and blunt weapons, causing injuries to them, and stole valuables from their residence.

Learned counsel for the petitioners submits that the petitioners are innocent, have clean antecedents, and have been falsely implicated due to an ongoing land dispute. It is submitted that the allegations against the petitioners are general and omnibus in nature.

Learned A.P.P. for the State opposes the prayer for anticipatory bail and draws the attention of this Court to the injury report, pointing out that Injury Nos. 1 and 2 sustained by the informant's husband on vital parts of the body are described as grievous in nature.

Having considered the submissions of the parties, so far as petitioner no. 1 (Md. Jisshan) and petitioner no. 4 (Md. Faizan) are concerned, in view of the specific allegations of inflicting grievous injuries on vital parts of the victim, this Court is not inclined to grant them anticipatory bail. Their prayer for anticipatory bail is accordingly rejected.

So far as petitioner no. 2 (Sabeya Rahman) and petitioner no. 3 (Saleya Rahman @ Saliya Khatoon) are concerned, it appears there is no specific allegation against petitioner no. 3, and petitioner no. 2 is a teenage girl against

whom the allegations are general and omnibus.

Accordingly, in the event of arrest or surrender

¶26

before the learned Court below within four weeks from today, petitioner no. 2 (Sabeya Rahman) and petitioner no. 3 (Saleya Rahman @ Saliya Khatoon) shall be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kesariya P.S. Case No. 452 of 2025, subject to the conditions laid down under Section 482(2) of the BNSS.
