The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 409 of 2026, registered for offences punishable under Sections 126(2), 115(2), 109(1), 303(2), 352, 351(2), and 3(5) of the BNS.

As per the prosecution case, the petitioner along with co-accused persons arrived armed with lathi, iron rod, and farsa, verbally abused the informant, and upon protest, the petitioner struck the informant on his head with a farsa. It is further alleged that co-accused persons assaulted the informant's sons and snatched Rs. 70,000/- from the informant's pocket.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated due to a longstanding land dispute between the parties, giving rise to a case and counter-case. It is submitted that the injury sustained by the informant is simple in nature, whereas the petitioner himself sustained a grievous injury. It is further submitted that the nature of injury suffered by the informant does not support the allegation of an assault by a farsa on the head, as a farsa blow would typically result in an incised wound. The petitioner is reported to have clean antecedents.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering case and counter-case, the simple injury of the informant as against the grievous injury sustained by the petitioner, and the clean antecedents of the petitioner, this Court is inclined to enlarge the petitioner on anticipatory bail.

Accordingly, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, the petitioner above-named shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, West
