The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Earlier, the prayer for grant of bail to the petitioner was rejected by this Court vide order dated 22.01.2025 passed in Cr. Misc. No. 77651 of 2024 with an observation that if the trial is not concluded within a period of one year, the petitioner shall be at liberty to renew his prayer for bail.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. It is submitted that till date, trial has not been concluded and the

examination of prosecution witnesses is still going on. It is further submitted that most of the witnesses who were examined on behalf of the prosecution have been declared hostile. Petitioner has got no criminal antecedents and he is in custody since 30.04.2024.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the facts and circumstances of the case, slow and tardy progress of trial, clean antecedents of the petitioner and period of custody, the prayer for grant bail of to the petitioner is allowed.

Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-I, Nawada in connection with Pakribawan P.S. Case No. 182 of 2024.
