Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.

As per prosecution case, on a petty dispute over irrigating the fields, a scuffle took place in which, all the F.I.R. named accused persons, including this petitioner, brutally assaulted mother of informant with lathi and danda due to which, she died on the spot.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Allegation of assault is general and

omnibus and no specific accusation of overt act has been alleged against this petitioner. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with other F.I.R. named accused persons, assaulted mother of informant with lathi and danda as a result of which, she died on the spot.

Considering the facts and circumstances of the case, specific and direct nature of accusation and gravity of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
