Heard learned counsels appearing on behalf of the petitioners; learned Standing counsel 9 appearing on behalf of the State and learned counsels appearing on behalf of the Bihar Public Service Commission.

The petitioners, in paragraph no. 1 of the present

writ petition, have sought inter alia the following relief(s), which is reproduced hereinafter:-

“i. The impugned order dated 04/04/25 passed by secretary cum presiding officer be set-aside whereby and whereunder the claim of the petitioners for issuing revised/supplementary result of TRE 3.0 for appointment of teacher in respect of standard 11 & 12 in the faculty of math after carrying forward left over 334 vacant seats of TRE 2.0 for unreserved category as per notification no. 27/2023 dated 06/12/2023 issued under the signature of Examination controller of Bihar Public Service Commission has been erroneously rejected.

ii. Further prayer is to direct the respondent authorities to carry forward the left over seats of TRE-2.0 for TRE-3.0 in respect of unreserved category of candidates and to publish supplementary revised list.

Further prayer is for quashing the impugned corrigendum dated 18/12/2024 issued under Advertisement no. 22/24.”

Learned counsel appearing on behalf of petitioners submits that earlier the petitioners have filed a writ petition bearing CWJC No.1540 of 2025, which was disposed of vide order dated 04.02.2025, with a direction to the Additional Chief Secretary, Education Department, Government of Bihar to dispose of the representation of the petitioners within a period of one month. In view of the direction contained in the order dated, 04.02.2025, petitioners have filed a detailed representation on on 11.02.2025 before the Additional Chief Secretary, Education Department but till date the Additional Chief Secretary is sitting tight over the matter. Even though five months have elapsed, the petitioners are still hopeful that they may have chance to qualify the Teacher Recruitment Examination (TRE)-3, if the case of the petitioners is considered in terms of the Advertisement. He further submitted that the Additional Chief Secretary may be directed to dispose of the representation of the petitioners, which is pending before him.

Considering the above submission, it is expected that the Additional Chief Secretary will not delay any further and dispose of the representation of the petitioners in

accordance with law and pass a reasoned order based on evidences and policies of the State Government, forthwith.
