Heard learned counsel for the petitioner and Mr. Arun

Kumar, learned APP for the State.

The petitioner has prayed for regular bail in a case

registered for the offence punishable under Sections 190, 191(3), 115(2), 126(2), 109, 303(2), 352, 351(2) and 351(3) of the BNS.

The case of the prosecution is that the petitioner has assaulted the informant with iron road on his head.

Learned counsel for the petitioner has submitted that there is land dispute between the parties and nature of allegation is general and omnibus. It has also been submitted that from perusal of the order of the trial court it does not transpire that the nature of injury was grievous. From the perusal of the order of the learned trial court it is clear that the trial court has simply recorded that injury report also

corroborates the allegation. Learned counsel further submits that there is no repetition of blow which shows the intention of the petitioner. The petitioner is in judicial custody since 14.08.2025.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaighat P.S. Case No. 195 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., court no.2, Muzaffarpur (East).
