Heard learned counsel for the petitioner and learned

A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence under Section 310(2) of the Bhartiya Nyaya Sanhita, 2023.

As per prosecution case, on the alleged date and time of occurrence, while the informant was returning from a marriage ceremony on his car along with his companions, in the meantime, 5-6 unknown miscreants riding on two motorcycles intercepted him near Jitan Chhapra village and looted mobile phone and cash.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name surfaced during course of investigation on the basis of confessional

statement of co-accused Sunny Kumar. Save & except confessional statement, there is no evidence against this petitioner. No incriminating article has been recovered from the possession of this petitioner. Petitioner claims clean antecedent.
