Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

The petitioner seeks bail in a case registered for offence under Sections 115(2), 126(2), 109, 324(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.

As per F.I.R., this petitioner along with other coaccused persons are alleged to have assaulted on the head of informant with iron rod and hockey stick, as a result of which, he sustained injuries.

Learned counsel for the petitioner submits that allegation of assault is general & omnibus and there is no specific accusation of overt act against this petitioner. Injuries, sustained by informant, are simple in nature. Petitioner is in custody since 19.06.2025. Chargesheet has been submitted.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that petitioner is named in the F.I.R. with accusation that he and other co-accused persons assaulted informant with iron rod and hockey sticks. Besides this, petitioner has got two criminal antecedent.

However, considering the period of custody, let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Addl. Sessions Judge, Biraul, Darbhanga in connection with Ghanshyampur P.S. Case No. 133 of 2025.
