Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party no. 2.

The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420, 467, 468, 385, 506 of the Indian Penal Code.

The prosecution case, in brief, is that informant, namely, Shilpi Kumari alleged that this petitioner posing himself to be the husband of informant, got a sale-deed executed for which money was given by informant, in which, this petitioner fraudulently incorporated his name, as husband of informant.

Learned counsel for the petitioner submits that

informant is wife of the petitioner and their marriage was solemnized in the year 2014 and in the year 2017, petitioner had taken a L.I.C. policy and made informant, as nominee, and similarly purchased a piece of land in the name of informant in the year 2021 withdrawing Rs. 5,80,000/- from his bank account in which petitioner’s name was mentioned as husband of informant. As a matter of fact, there is matrimonial dispute between the parties, which has been given a colour of criminal offence. Petitioner claims clean antecedent.

However, learned counsel for opposite party no. 2 vehemently opposes the prayer for anticipatory bail and submits that informant is not wife of petitioner and this petitioner fraudulently mentioned his name, as husband of informant, in the aforesaid sale-deed and other documents.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar / concerned Court in connection with Buxar Town P.S. Case No. 455 of 2024, subject to condition as laid down under Section
