Petitioner seeks regular bail in connection with Jamui P.S. Case No. 525 of 2023, dated 25.08.2023 in a case registered for the offences punishable under Sections 341, 323, 307, 379, 120B/34 of the Indian Penal Code.

As per prosecution story, the informant alongwith his younger brother Dharanjay Singh were plucking vegetables in their own field. In the meantime, FIR named accused persons including the present petitioner came to informant’s field and demanded the vegetables as Rangdari, when brother of informant denied they started assaulting them. Petitioner is said to have assault the informant’s brother with iron rod and accused person also chased the informant to assault

him but he run away. The brother of informant namely, Dhananjay Singh was shifted to Sadar Hospital, Jamui in critical condition.

Learned senior counsel for the petitioner submits that allegation of assault is general and omnibus. Similarly situated co-accused, namely, Neeraj Singh, who as per F.I.R. assaulted the deceased with butt of rifle has already been granted bail by a co-ordinate Bench of this Court vide order dated 10.12.2024 passed in Cr. Misc. No.57597 of 2024. Petitioner is in custody since 26.12.2024.

Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner is named in the F.I.R. and there is specific allegation against the petitioner is that he repeatedly assaulted on the head of the deceased with the iron rod.

Considering the nature of accusation and stage of the trial, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 26.12.2024, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
