Heard learned counsels for the Petitioner and Mr. Rajendra Singh learned APP for the State.

2. Petitioner seeks regular bail in connection with Kharagpur P.S. Case No. 97 of 2024, dated 18.03.2024 registered for the offences punishable under Sections 364, 302, 201 and 34 of the Indian Penal Code.

The main submissions advanced by petitioner's counsel are that though the petitioner is named in the FIR but against him, mainly suspicion has been raised by the informant in the last portion of the FIR, in fact, the deceased was having an illicit relationship with his own cousin sister due to which his own family members got annoyed and finally they might have

murdered the victim, and the killing of the deceased appears to be a case of honour killing, in this regard the informant’s own statement mentioned in the case diary at paragraph no. 65 may be perused. It is further submitted that as per the prosecution story, mentioned in the FIR the co-accused Janardhan Tanti took the victim from his house and thereafter, the victim went missing and when the informant asked him whereabouts of the victim then he did not give satisfactory answer, so the main suspicion with regard to the disappearance of the victim was raised by the informant towards the said co-accused person Janardhan Tanti with whom the informant had no good relation at the time of registering the FIR but, these allegations were not against this petitioner and the later part of the FIR, only reflects a simple suspicion against this petitioner without any basis. It is further submitted that the petitioner is not a close family member of the informant rather he is an agnate of him. It is lastly submitted that the petitioner has fair criminal antecedent and has been in custody since 09.02.2025 and investigation has also been completed against him.

4. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner but wholly accepts that the informant stated in his statement that the victim might have

been killed by his own family members due to his illicit relationship with his own cousin sister and against this petitioner there is only suspicion raised by the informant.

Considering the aforesaid submissions advanced by both the sides and mainly the fact that against this petitioner there is no direct evidence showing his involvement in the alleged murder and the informant simply raised suspicion against him and lastly considering the petitioner’s clean antecedent and his custody period as well as the completion of investigation against him, I am inclined to grant relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Kharagpur P.S. Case No. 97 of 2024.
