Heard learned counsel for the petitioner as well as

learned APP for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 17C of 2024, registered for the offences punishable under Sections 354(B), 376, 511, 377, 511 of BNS and u/s 8 of POCSO Act.

The complainant stated that on 22.02.2024 at about 6:00 PM, her daughter (aged 8 years) was going with her cousin to a nearby temple program. When they reached near an orchard, the petitioner, who was already present there, stopped her daughter and behaved in improper manner. When her cousin protested, the petitioner tore his clothes. On their shouting,

family members arrived, and the petitioner escaped taking advantage of the darkness.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He is a person of clean antecedent. There is delay of one month in lodging of the FIR.

On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that witness no. 1 and witness no. 2 have supported the prosecution case stating that the petitioner attempted to commit rape with the victim, who is 8 year old minor girl.

Considering the above-mentioned facts and circumstances, in my view, the petitioner doesn’t deserve the privileges for anticipatory bail. Accordingly, it is rejected.
