Heard learned counsel for the petitioner and learned APP

for the State.

The petitioner is apprehending his arrest in Complaint Case No. 2262 of 2018 (Trial No. 2061 of 2022) registered under Sections 498(A), 406/34 of the IPC and Section 4 of the D.P. Act.

It is a case of matrimonial dispute.

Vide order dated 21.07.2023, the matter was referred to the Patna High Court Mediation and Conciliation Centre for exploring the possibility of amicable settlement of the dispute between the parties. The report of learned Mediator shows that the mediation has failed on account of non-appearance of the parties.

Learned counsel for the petitioner has submitted that the the petitioner is innocent and has falsely been implicated in the present case. He has further submitted that the reason behind filing of this false case is not the atrocities alleged to have been inflicted by the petitioner and his family members rather the dispute arose from the year 2018 when the wife (O.P. No. 2) sold the land of the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Complaint Case No. 2262 of 2018 (Trial No. 2061 of 2022), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
