In the present case, the petitioner seeks bail in connection with Beldaur P.S. Case No.203 of 2022, registered for the offences under Sections 302, 201/34 of the IPC.

As per the prosecution case, the dead body of a female was found floating in water beneath a bridge. Subsequently, it came to the knowledge that the dead body was of wife of one Nipal Tanti. The name of the petitioner transpired during the investigation for being involved in the murder of wife of Nipal Tanti.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of the petitioner came

up during investigation on the basis of call record of the mobile phone of the deceased and merely on suspicion, the petitioner has made accused in this case. The petitioner had no enmity with the deceased and merely talking with the deceased on the mobile phone could not be a ground to implicate the petitioner for her murder without any cogent evidence. No substantive material has come up to connect the petitioner with the offense as alleged. The petitioner is aged about 60 years and a covillagers of the deceased. The petitioner is having no criminal antecedent and he is in custody since 01.12.2023.

Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned APP submits that on the basis of call detail reports, it appears that the petitioner was in regular contact with the deceased prior to the death.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the vague nature of allegation against the petitioner and also considering the clean antecedent of the petitioner, his period of custody and submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional

Sessions Judge-VII, Khagaria/concerned court in connection with Beldaur P.S. Case No.203 of 2022, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

¶24

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

¶25

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
