Heard learned counsel for the petitioners and learned

APP for the State.

In the present case, the petitioners seek bail in connection with Angarghat P.S. Case No. 38 of 2023 registered for the offences under Sections 304(B) and 328/34 of the Indian Penal Code.

As per prosecution case, on account of nonfulfillment of demand of dowry, the petitioners and other coaccused persons killed the sister of the informant in her matrimonial home within 7 years of her marriage.

Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. The petitioners are parents-in-law

of the deceased and they have been living separately from their coaccused son. On the alleged date of occurrence, petitioner no.2 was at her grocery shop whereas petitioner no.1 was at Samastipur. When the neighbours informed the petitioners that their daughterin-law has committed suicide, they rushed to the place of occurrence. Learned counsel further submits that there has never been any demand of dowry from the petitioners and no complaint was ever made by the deceased regarding such demand.The postmortem report does not show any apparent cause of death though viscera has been preserved for FSL report. The petitioners are in custody since 25.08.2024 and charge-sheet has been submitted. Petitioner are having clean antecedent.

Learned A.P.P. opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that the petitioners are stated to be in-laws of the deceased and the allegations are non-specific against the petitioners and further considering the doubtful cause of death and also considering the clean antecedent of the petitioners coupled with their period of custody and submission of charge-sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two

sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Samastipur/concerned court in connection with Angarghat P.S. Case No. 38 of 2023, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

¶25

(ii) The petitioners will remain present on each and every date fixed by the court below.

¶26

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable

to be cancelled by the court concerned.
