The petitioners apprehend their arrest in connection with Jamui P.S. Case No. 430 of 2023 instituted under Sections 147, 149, 341, 323, 325, 308, 354 (B) and 504 of the Indian Penal Code.

As per the prosecution case, on 10.07.2023 at 06:00 P.M. due to old land dispute and playing of children, the accused persons including the petitioners having lathi, danda, iron rod came and abused the informant. Petitioner Pappu Mandal caused arm and shoulder injury to informant and Rohit Mandal gave a lathi blow to the nephew of the informant on his head and the petitioner no. 2 with one Sachin Mandal also assaulted the dauther-in-law of the informant when she intervened.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the instant case. Both the parties are neighbour having their house adjacent to each other. He further submits that due to dispute between the children the occurrence took place in which both the parties got some injuries. However, no grievous injury was caused to anyone. Petitioners are ready to cooperate in investigation of this case.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned A.D.J.-III, Jamui in connection with Jamui P.S. Case No. 430 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
