The petitioner apprehend his arrest in connection with Nadi P.S. Case No. 127 of 2023 instituted under Sections 457, 380 and 34 of the Indian Penal Code.

As per the prosecution case, there is allegation of robbery from the shop of the brother of the informant by the petitioner and other accused persons.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he has been falsely implicated in this case. He further submits that co-accused has named the petitioner as his associates, however, nothing has been recovered from the house of the petitioner and the petitioner has no concern with the co-accused.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna City or Concerned Court Below in connection with Nadi P.S. Case No. 127 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
