The petitioners apprehend their arrest in connection with Bidupur P.S. Case No. 377 of 2022 instituted under Sections 147, 148, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner no. 1 is that he along with the co-accused Puja Kumari had given iron rod blow on the head of the informant and allegation against the petitioner no. 2 is that he had given threat to kill her if case be filed.

Learned counsel for the petitioners submits that the

petitioners are innocent and have been falsely implicated in this case. He further submits that the injury on the informant is simple in nature and due to misconception the informant has filed the present cases. He also submits that there is case and counter case between the parties and the petitioners have one criminal antecedent. Both the parties belongs to same family.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned CJM Vaishali at Hajipur or Concerned Court Below in connection with Bidupur P.S. Case No. 377 of 2022, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
