Heard learned counsel for the petitioner and

learned APP for the State.

The petitioner seeks bail in connection with Sourbazar P.S. Cae No. 814 of 2023 registered for the offence under Sections 363, 366-A of the Indian Penal Code and under Section 4 and 18 of the POCSO Act.

Learned counsel for the petitioner has submitted that though the allegation against the petitioner is of kidnapping the victim girl but from the impugned order, it is clear that the

petitioner and the victim girl were in a relationship.

The petitioner is in jail since 25.4.2024.

Considering the aforesaid facts, this application

is allowed.

Let the petitioner, above named, be released on

bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court, POCSO, Saharsa/concerned Court below in connection with Saurbazar P.S. Case No. 814 of 2023.
