Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 291 of 2019 registered for the offence under Sections 147, 148, 149, 341, 323, 447, 448, 354(B), 506/34 of the Indian Penal Code.

This is a case of year 2019 and the petitioner is an absconder as he is in custody since 28.03.2024.

In view of the above, this application is allowed but the petitioner, above named is directed to be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the

satisfaction of the learned Judicial Magistrate,

Saharsa/concerned Court below in connection with Bakhtiyarpur P.S. Case No. 291 of 2019, subject to the condition that one of the bailors should be close blood relative of the petitioner.

The petitioner is directed to be released after framing of charge so that the trial is not hampered in any way.

As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Bakhtiyarpur (Kanaria O.P.) Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
