Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 324, 307, 354, 379 and 506 of the Indian Penal Code as well as Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is aged about 85 years but in the FIR his age is disclosed as 75 years.

The informant alleges that on account of dispute relating to land Pramod Sharma assaulted by an iron rod causing injury on his head. Thereafter, petitioner assaulted the informant by Khanti and Gulshan Kumar assaulted his maternal nephew by an iron rod causing injury on his head. Shankar Kumar assaulted the wife of the informant with an iron rod causing

injury on her hand. Thereafter, Jagdish Singh assaulted the nephew of the informant by lathi causing injury on his head, Prem Ranjan Singh assaulted his sister by lathi and accused persons snatched chain and earring of his wife and Bhabhi.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case by the informant. It is further submitted that petitioner is aged about 85 years and has remained a person with clean antecedent and all of a sudden he has been made criminal by the informant with an allegation that he assaulted the informant by Khanti. It is next submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Islampur P.S.
