Heard learned counsel for the petitioner as well as

learned APP for the State.

In this case, the petitioner is seeking regular bail

¶15

in connection with Sakri P.S. Case No. 37 of 2024, registered for the offences punishable under Sections 420, 376, 506 of the Indian Penal Code.

The petitioner was a friend of the husband of the informant. As per allegation, the petitioner took her and her husband’s signature on a blank paper under the pretext of making a ration card. For around six months, he blackmailed her and established relationship with her.

Learned counsel for the petitioner submits that as

a matter of fact the husband of the informant had taken Rs. 80,000/- from the petitioner and he entered into an agreement with the petitioner but despite that he did not return the money. Learned counsel has submitted further that there is allegation in the FIR that the petitioner obtained signature of husband of the deceased on a blank paper on the pretext of facilitating ration card to him but as a matter of fact, the informant and her husband are already ration card holders. The FIR has been lodged after 7 months of the occurrence. The petitioner is under custody since 16.03.2024.

On the other hand, the learned APP has opposed the prayer for bail by submitting that the victim in her statement under Section 164 of the CrPC has supported the occurrence.

It is undisputed that the FIR has been lodged after 7 months of occurrence. There is allegation that the petitioner obtained the signature of husband of the victim on a blank paper on the pretext of facilitating ration card but the informant and her husband are already ration card holder. It appears that both the parties have already compromised the case.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on

bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Sakri P.S. Case No. 37 of 2024, subject to the following condition:-
