The petitioner apprehends his arrest in connection with Maheshkhunt P.S. Case No.225 of 2023 instituted under Sections 341, 323, 386, 387, 504, 506 & 34 of the Indian Penal Code.

As per prosecution case, informant has alleged that he has three Kattha land in the name of his wife which was encroached by the co-accused Niranjan Yadav. The said land was vacated by the order of Chief Minister in Janta Darbar but the co-accused Niranjan Yadav and 8-10 co-accused persons again encroached his land. It is alleged that the said accused persons have assaulted and ousted him from his land and demanded Rs.5 lakhs as extortion.

Learned counsel for the petitioner submits that

there is general allegation against the petitioner and the allegation of demand of extortion ( rangdari ) is against coaccused Niranjan Yadav. He further submits that there is a land dispute between the parties. Learned counsel submits that petitioner has no criminal antecedent and he has been falsely implicated in this case. He further submits that petitioner has no concern with the co-accused Niranjan Yadav.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned A.C.J.M. IV^th , Khagaria in connection with Maheshkhunt P.S. Case No.225 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
