Jalaluddin @ Chhotu, no T.I.P. was done, he was in custody since 07.12.2023, had one criminal antecedent under the Excise Act (in which he is on bail), and the similarly situated co-accused had already been granted regular bail by this Court on 22.01.2024 in Cr. The petitioner seeks regular bail in connection with Gaya Muffasil P.S. Case No. 433 of 2023, registered for the offences punishable under Sections 356 and 379 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner and other is to snatch the bag of the informant containing cash of Rs. 2,60,000/-, laptop and other important documents and fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the F.I.R. and his name has been surfaced in this case on the confessional statement of co-

accused, namely, Md. Jalaluddin @ Chhotu and except the same, there is no material against the petitioner to show his involvement in this case. No T.I.P. has been done in this case. He also submits that petitioner is in custody since 07.12.2023. He has one criminal antecedent which belongs to Excise Act in which he is on bail. He further submits that the similarly situated co-accused person, namely, Md. Jalaluddin @ Chhotu has been granted regular bail by this Court vide order dated 22.01.2024 passed in Cr. Misc. No. 84836 of 2023.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1^st Class, Gaya in connection with Gaya Muffasil P.S.
