Heard the learned counsel for the petitioner and the

learned APP for the State along with learned counsel for the O.P. No.2.

The learned counsel for the petitioner after some argument submits that he will represent before the concerned police official in terms of the judgment passed by the Hon’ble Supreme Court in the case of Arnesh Kumar vs State Of Bihar & Anr reported in (2014) 8 SCC 273 .

The petitioner is permitted to file representation bringing to the notice of the concerned Investigating Officer and the Superintendent of Police of the district the judgment of the Hon’ble Supreme Court in the case of Arnesh Kumar (supra),

Asfak Alam vs State Of Jharkhand reported in 2023 LiveLaw (SC) 583 and the Circular issued by the Registrar General of the High Court of Judicature at Patna in compliance of the order passed by the Hon’ble Supreme Court in the case of Md. Asfak Alam vs State of Jharkhand and Anr contained in Memo No.62973/AD(Rules) 19^th September, 2023 .

The Court directs that in the event if any representation is filed by the petitioner bringing the aforesaid orders and circular to the notice of the concerned Investigating Officer and the Superintendent of Police of the district in that event the police will act in compliance of the direction of the Hon’ble Supreme Court in the aforesaid judgment.
