The petitioner has preferred this application for grant of regular bail in connection with Jagdishpur P.S Case No. 413 of 2021 dated 17.12.2021 registered for the offences punishable under sections 302 and 120B read with 34 of the Indian Penal Code.
As per the prosecution case, the informant has alleged that the co-accused persons being brother-in-law and sister-inlaw of the son of the informant have killed the son of the informant.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the statement of the co-accused Bajrangi Yadav, recorded u/s 164 of the Cr.P.C. The other coaccused persons have already been granted bail by the Coordinate Bench vide order dated 13.02.2023 passed in Cr. Misc. No. 41600 of 2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.05.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in S.T. No. 345 of 2022 arising out of Jagdishpur in connection with Jagdishpur P.S. Case No. 413 of 2021.
The application stands allowed.
