The petitioner has preferred this application for grant of regular bail in connection with Bettiah P.S Case No. 456 of 2022 dated 17.06.2022 registered for the offences punishable under sections 143, 147, 148, 149, 341, 323, 353, 332, 333, 338, 435, 307, 427, 504, 120B, 395 and 412 of the Indian Penal Code

and section 27 of the Arms Act and section 3 / 4 of the Prevention of Damage to Public Property Act.

As per the prosecution case, 500-700 demonstrators armed with lathi , rod, iron pipe went towards Railway Station and stated damaging and burning engine of the train as well as damaged the private vehilces and also misbehaved with public shopkeepers and other officials by way of pelting stones and attempting to set the Government vehicles on fire in retaliation of implementation of a Government Scheme for Agnipath .

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up during the course of investigation. The petitioner is a bhunja seller. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 30.11.2022 passed in Cr. Misc. No. 55032 of 2022. The petitioner is accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 22.06.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
