Heard learned counsel appearing on behalf of the petitioner and learned APP appearing for the State.
This application is filed for modification of order dated 10.01.2023 passed in Criminal Miscellaneous No. 51306 of 2022.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has been granted pre-arrest bail on 10.01.2023 passed in Criminal Miscellaneous No. 51306 of 2022 with a direction to surrender before the court below within a period of six weeks on furnishing bail bonds of Rs. 20,000/(Twenty thousand Rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
Patna High Court CR. MISC. No.21156 of 2023(2) dt.05-04-2023 2/2
Nalanda at Biharsharif in connection with Laherimuhalla P.S. Case No. 74 of 2022, but due to Jaundice, the petitioner could not surrender and execute the bail bonds before the Court below within stipulated time.
In view of the aforesaid facts, let the time to surrender of the petitioner and to execute bail bonds, as ordered on 10.01.2023 passed in Criminal Miscellaneous No. 51306 of 2022, be further extended by four weeks from the receipt of this order.
Accordingly, the modification application is allowed and the order dated 10.01.2023 passed in Criminal Miscellaneous No. 51306 of 2022 is modified to the above extent.
This application stands disposed of.
