Heard the learned counsel for the petitioners as well

as the learned Additional Public Prosecutor for the State.

The petitioners are seeking regular bail in connection

with Malyapur P.S. Case No. 126 of 2022, registered for the offences punishable under Sections 467, 468, 420, 414/34 of the Indian Penal Code.

As per allegation, a stolen truck from Dhanbad was found in Malaypur, Jamui. Some persons, who were near that truck as well as the labourers of garage, where the truck was being dismantled, were made accused.

The learned counsel for the petitioners has submitted that they are innocent and are labourers working in that garage .

They are the persons of clean antecedent and under custody since 20.10.2022. He has submitted further that co-accused Sunil Sharma has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 5402 of 2023.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Malyapur P.S. Case No. 126 of 2022, subject to the following conditions:-

(i) The petitioners shall cooperate in the

disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
