3 07-07-2023 Heard learned counsels for the petitioners, informant and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 325, 324, 447, 379 and 504 of the Indian Penal Code.

It is alleged that these petitioners assaulted family members of the informant as a result of which they sustained injuries.

Learned counsel appearing for the petitioners submits that there is case and counter case between the parties and injuries allegedly caused by these petitioners are found to be

Learned counsel for the informant vehemently opposes the bail application.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Benipur, Darbhanga in connection with Alinagar P. S. Case No. 85 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
